Ben has a history of solving complex problems for his clients inside and outside of the courtroom. An award-winning extemporaneous speaker and writer, Ben credits his ability to create a persuasive argument to his time as editor in chief of the SMU Science & Technology Law Review, and as an intern for Bryan Garner, one of the nation’s preeminent legal-writing experts. Ben spent years working as a supervisor in the customer-service center for a large state agency, and he is adept at addressing and resolving complicated, intense issues. He now brings these skills to bear in helping business clients, guiding them through troubling circumstances to find the outcome that best meets their needs.
Ben has represented small “mom and pop” companies, international airlines and national shipping companies, and everything in between. He has experience in aviation, transportation, class-action defense, and general commercial litigation, and has also worked with property owners’ associations in handling both transactional and litigation matters. Ben is adept at all phases of litigation, having handled matters from pre-suit negotiation all the way through trial and the appeals process.
IAS Medical Ltd. v. Williams Airmotive, Inc., et al. – Obtained take-nothing defense verdict from a jury in a suit against an Indiana aviation-repair business where the plaintiff sought $1.2 million in damages.
Kirst v. Ottosen Propeller & Accessories, Inc., et al. – Obtained dismissal by summary judgment of claims against a propeller-repair business where the plaintiff sought damages in excess of $1 million, and successfully defended that summary judgment on appeal before the U.S. Ninth Circuit (2019 WL 3814710).
Negotiated favorable settlements for numerous clients, including for international airline in personal-injury case brought by passenger seeking $150,000 in damages and for Part 145 repair station in personal-injury case brought by passenger seeking $1.3 million in damages.
