Our team has successfully defended our clients position in agency level bid protests, bid protests with the Government Accountability Office (GOA), and disputes in the Court of Federal Claims (COFC). Representative Aviation Experience

Drafted and negotiated series of contracts relating to logistics company’s facility expansion which utilized combined public and private funding.

Advised airports through creation and negotiation of financing agreements, land use agreements, operating agreements and acquisition of FAA funding.

Represented an airline in a series of investigations, notices of civil penalties and FAA /U.S. Department of Transportation complaints.

Routinely advise clients on all aspects of national, state and local logistical regulatory compliance, including Federal Motor Carrier Safety Administration (FMCSA) regulations, Federal Transportation Administration (FTA) regulations and grants, and Occupational Safety and Health Administration (OSHA) regulations

Defended highway construction contractor from $12.0 million claims involving alleged defective painting claims, completely exonerating client from any liability.

Representative Construction Experience

Successfully Resolved $4.0 million claim against the United States Corps of Engineers involving Florida Everglades Restoration Project.

Defense and prosecution of lien, payment and performance claims arising from construction of interstate transmission lines.

Successfully defended SDVOSB general contractor in size and status protests in front of SBA OHA.

Obtained full claim value involving design-build Air Force hangar fire suppression system involving renovation project at Joint Base Andrews.

Prevailed on behalf of general contractor in multi-million-dollar jury trial on Ohio municipal waste water treatment plant.

Represented a general contractor in a dispute with a county regarding construction of a $40 million prison.

Represented a contractor in a dispute involving a bidder’s failure to meet design specifications for the multimillion-dollar relining of water piping and involving enforcement of Pennsylvania’s Right to Know Act.

Energy

Representative Energy Experience

Obtained large settlement for subcontractor on multi-billion dollar Department of Energy (DOE) nuclear clean-up project against ENR Top Ten construction manager.

Advised environmental service contractor on issues related to alleged organizational conflict of interest related to DOE contract and prepared OCI mitigation plan to address same.

Defense and prosecution of claims on nuclear energy construction projects (reactor, fuel, and conversion facilities). Prosecution of claims and close out of EPC contracts on utility-scale solar facilities.

Assistance in project execution and lien and payment disputes for wind energy projects.
Defense and prosecution of claims related to utility facilities new construction and maintenance construction.

Defense and prosecution of design error and misrepresentation claims on utilities projects.

Experience handling approvals before state regulatory agencies involving:

  • Utility financings totaling more than $1 billion
  • Establishment of utility regulatory assets for accounting treatment totaling more than $200 million

Manufacturing

Representative Manufacturing Experience

Represented steel fabricator and erector in a lawsuit filed in Florida against an NFL football team, the design professional, and the construction manager, regarding rehabilitation of an NFL football stadium in Florida, involving a multi-million dollar claim on behalf of our client. After a week and a half of trial, the matter was settled.

Represented a steel fabricator and steel erector in a lawsuit against the owner and general contractor on a condominium project outside of Cincinnati, Ohio. We received a verdict in excess of $1,000,000 at trial.

Conducted trial in the Armed Services Board of Contract Appeals challenging termination for default of mechanical contractor.

Project coordination and execution of plastics and polyester production facilities.

Successfully protested Air Force procurement action involving personal protective equipment for firefighters.

Represented a medical device developer regarding submission of proposal to Defense Advanced Research Project Agency (DARPA) in protection of intellectual property.
