Biography

Alex has extensive experience representing municipalities, municipal employees, and elected office holders in a variety of litigation, both at the trial court and appellate levels. He has been lead counsel in a number of jury and bench trials representing the State of Indiana and the Consolidated City and County of Indianapolis-Marion County, and he has also defended his clients from several demands for preliminary injunctions. He has briefed and argued cases before both the Indiana Court of Appeals and the Court of Appeals for the Seventh Judicial Circuit.

As Chief Litigation Counsel for the City of Indianapolis, Alex oversaw all litigation for his client and worked on a variety of state law tort claims brought under the Indiana Tort Claims Act. In his municipal practice, Alex gained valuable experience with a variety of state and federal constitutional challenges including claims against police officers for violation of the Fourth Amendment, claims challenging the constitutionality of local ordinances, and claims against municipalities for violation of equal protection and due process. He also has extensive experience defending municipalities and public office holders in labor and employment cases, particularly in claims for violation of Title VII and the Americans with Disabilities Act. In addition, Alex previously served as the legal adviser to the Chief of the Indianapolis Metropolitan Police Department.

Prior to working for the City of Indianapolis, Alex served as a Deputy Prosecuting Attorney for Marion County, representing the State of Indiana in the Major Felony Division and the Strategic Narcotics Prosecution Division.

Legal Work Highlights

Successfully tried and defended the City of Indianapolis’s Amended Smoking Ordinance in a final injunction hearing before the Southern District of Indianapolis

Received defense verdict in two federal employment law actions against City of Indianapolis alleging violations of Title VII and the Americans with Disabilities Act

Successfully argued for the Seventh Circuit to enter summary judgment for IMPD police
detective in Brickely v. McComas after he had been accused of false arrest.

Defended numerous motions for preliminary injunctions filed against the City of Indianapolis, including a challenge to public bidding on towing services and a challenge to disbursement of settlement proceeds following an environmental cleanup.

Assisted in briefing and oral argument preparation for appellate counsel in Armour v. City of Indianapolis decided by the U.S. Supreme Court

Defended numerous elected officials at jury trials, bench trials, summary judgment and
injunction hearings, including the Marion County Sheriff and the Marion County Coroner, among others
