Litigation regarding an employer’s ability to terminate an employee while the employee is receiving workers’ compensation benefits – In October 2003, the Ohio Supreme Court unanimously ruled that an employer may not terminate an employee who is receiving temporary total disability benefits if the termination is based upon absence(s) caused by the on-the-job injury. We successfully convinced the Ohio Supreme Court to overturn its previous, unanimous decision.
