Sanitary Sewer Overflow (SSO)

The client is a quasi-public entity created pursuant to Indiana statute to oversee the remediation and redevelopment of the 6,000-acre former Indiana Army Ammunition Plant in Clark County, Indiana, along the Ohio River. FBT assisted the client in assessing and resolving legal and regulatory concerns related to a series of long-term sanitary sewer overflows on its property caused by its historical wastewater system operator and negotiating an agreement to terminate the services of the wastewater system operator and resolve pending litigation regarding the terms under which those services were to be performed. Tim Hagerty worked directly with the client’s executive director and board in addressing and resolving these issues.
