Lindsay focuses her practice on financial services and consumer lending. Having previously served as in-house counsel with one of the nation’s largest full-service banking franchises, she has extensive experience with the regulatory needs of banks and other financial service providers. She also focuses her practice on the FinTech and payment systems industries, helping clients merge technology with traditional banking and lending products, and advising them on money transmission laws and regulations.
Lindsay regularly advises banks, mortgage lenders, consumer finance companies, money transmitters, credit unions, and FinTech providers on regulatory compliance, licensing, and enforcement matters. Specifically, Lindsay has experience with federal and state laws related to mortgage and consumer lending, including the Truth in Lending Act (TILA), the Fair Credit Reporting Act (FCRA), the Equal Credit Opportunity Act (ECOA), the Fair Housing Act (FHA), the Real Estate Settlement Procedures Act (RESPA), Electronic Funds Transfer Act (EFTA), the Fair Debt Collections Practices Act (FDCPA), the Gramm-Leach-Bliley Act (GLBA), Electronic Signatures in Global, and National Commerce Act (E-SIGN), and Anti-Money Laundering and Countering the Financing of Terrorism (AML/CFT) laws. She has successfully advised clients on CFPB enforcement actions and examinations, HUD investigations, and mortgage and money transmitter licensing.
Lindsay also advises mortgage clients on fair lending matters, including redlining and appraisal discrimination risk, and assesses clients’ mortgage lending data to help strengthen their fair lending programs. She is also well-versed in vehicle-secured lending, lines of credit, unsecured lending, and consumer leasing.
Prior to joining Frost Brown Todd, in addition to serving as in-house counsel at a national bank, Lindsay worked at another well-known national law firm and served as regulatory counsel at a leading consumer financial services company in Cincinnati, Ohio.
Successfully represented mortgage lender and money transmitter licensee in state license revocation and enforcement actions, resulting in no license revocation.
Represented buyer in acquisition of money transmitter licensee, advising on license change of control requirements and conducting due diligence under money transmitter laws.
Represented client in HUD fair lending complaint alleging discrimination under the Fair Housing Act.
Advised fintech lenders on new product launches, consumer-facing agreements and disclosures, and consumer regulatory obligations.
Drafted account agreement, payment authorizations, and overdraft disclosures for depository institution client.
Counseled agricultural lender on commercial financing disclosure laws in California, New York, Florida, Georgia, and Virginia.
Advised medical billing servicer on Truth in Lending disclosures and payment intake process flows for medical billing payment plans.
Counseled motor vehicle dealer on application of state laws to auto leasing and short-term car rentals.
Assisted remittance transfer provider in applying for California money transmitter license.
Counseled financial institutions on obligations under the Bank Secrecy Act and AML/CFT compliance, and conducted AML/CFT risk assessments.
Represented mortgage lenders in fair lending complaints brought by the Ohio Civil Rights Commission.
Advised educational institution on required disclosures for tuition payment plans and best practices for student financial responsibility agreements.
Conducted fair lending assessments of mortgage lenders’ HMDA data in preparation for state compliance and CFPB examinations.
Created compliance program and risk assessments for startup fintech lender to comply with consumer regulatory laws.
