Biography

Ann uses her broad experience in intellectual property law to help clients achieve their business goals. A registered patent attorney, Ann advises clients on the best methods to protect and capitalize on their innovations. She guides clients in cost-effectively building and maintaining an international patent portfolio. She regularly counsels clients faced with intellectual property disputes, resolving the matters through product redesign, licensing, or, if necessary, litigation. She has litigated patent, trademark, and trade secret cases related to, among other things, food dyes, agricultural products and equipment, electronic locks, consumer products, financial services, catalytic converters, automotive steel, and industrial equipment in federal courts around the country.

Ann is the Intellectual Property Practice Group Leader. She is also an adjunct professor, teaching Patent Law at the Chase College of Law, Northern Kentucky University. Prior to joining Frost Brown Todd, she worked as in-house patent counsel at General Electric. Before becoming a lawyer, Ann worked as an engineer at General Electric.

Legal Work Highlights

Provides IP counseling, addressing licensing, freedom to practice issues, and patent and trademark portfolio management (both domestic and international) for, among other, a metals manufacturer, a producer of roll-formed construction products, and manufacturers of consumer goods.

Obtained ruling of summary judgment of non-infringement of a patent related to agricultural equipment, a ruling that was upheld after appeal. GLG Farms LLC v. Brandt, Case No. 4:14-cv-00153, District of North Dakota; Case Nos. 2017-1937, -1973, Court of Appeals for the Federal Circuit (2018).

After receiving a favorable claim construction in a patent infringement case related to handheld car diagnostic devices, the parties stipulated to a judgment of non-infringement. The plaintiff voluntarily dismissed its appeal and the case was concluded. CarCheckup, LLC v. CarMD.com Corp. and Innova Electronics Corp., Southern District of Indiana, Case No. 1:13-cv-1035-SEB-TAB (2014).

Satisfactorily resolved a trademark infringement litigation related to a glove trademark. totes Isotoner Corporation v. PVH Corporation, Case No. 1:13-cv-786, Southern District of Ohio (2014).

Negotiated resolution of patent litigation in two different jurisdictions involving multiple patents related to heavy duty vehicular lifts. Stertil-Koni USA, Inc. v. Vehicle Service Group, LLC, 1:12-cv-02254-CCB, District of Maryland and Vehicle Service Group, LLC v. Stertil-Koni USA, Inc., 4:12-cv-00109-SEB-WGH, Southern District of Indiana (2013).

Obtained ruling of summary judgment of noninfringement of a patent relating to a pediatric emergency transport device. Pediatric Medical Devices, Inc. v. Indiana Mills & Manufacturing, Inc., Case No. 1:11-cv-2613-TCB, US District Court for the Northern District of Georgia (2013).
