A panel of the Sixth Circuit of Appeals unanimously affirmed the dismissal of several antitrust claims brought by a radiologist against two hospitals and former hospital executives represented by Frost Brown Todd. In Nilavar v. Mercy Health Systems-Western Ohio, a radiologist asserted federal and Ohio antitrust claims that the hospitals’ exclusive, a radiologist asserted federal and Ohio antitrust claims that the hospitals’ exclusive radiology provider contract was an unreasonable restraint of trade. Frost Brown Todd’s earlier trial court victories in the case included the disqualification of the plaintiff’s economics expert who attempted to define the relevant product and geographic markets.
