Municipal POTW: Clean Water Act Enforcement

Representation of a county board of commissioners in Clean Water Act enforcement action. Negotiated an administrative order resolving allegation of unsanitary conditions resulting from failing or inadequate on-site aeration sewage disposal systems. The county was given nine months to submit a permit-to-instal, Anti-degradation Addendum and National Pollutant Discharge Elimination Systems (“NPDES”) permit application, to commence construction within 12 months after approval of such application. No civil penalty.
