FBT filed an action on behalf of Middletown Regional Health System inWarren County, Ohio, Court of Common Pleas, against an environmental consultant and its subcontractor for negligent inspection of real property and professional malpractice. The hospital hired the consultants to inspect a parcel of land before the hospital purchased it for a new hospital site. After the purchase, the hospital discovered thousands of used tires and many tons of solid waste on the site. The hospital therefore brought an action against the consultants, for failing to discover and disclose the presence of the tires and waste.
