We represented the plaintiffs-appellants in this action by members of an agricultural cooperative challenging actions by the cooperative. The lower court’s dismissal of the action was affirmed on the grounds that removal of the action from state court was proper and that the action was a derivative action for which a demand on the board had not been made.  Court Citation: 312 Fed.Appx. 752 (6th Cir. 2009).
