The Kentucky Energy & Environment Cabinet ("Cabinet") issues an Abate and Alleviate Order against Pregis over alleged violations of the Clean Water Act and discharges of Methylene Chloride to the Ohio River. The Abate and Alleviate Order mandated that Pregis cease all manufacturing at their Wurtland, Kentucky plant within 10 days. The FBT Team immediately negotiated an interim order that allowed the plant to continue operating. The FBT team then conducted extensive fact and expert discovery. In response to the submission of extensive and compelling expert reports on behalf of Pregis, the Cabinet extended a settlement offer. Pregis accepted the settlement.
